This Website Waiver, Notice, and Purchaser Acknowledgment applies to all aftermarket steering wheels, air-bag covers, lights, side markers, key fobs, replacement parts, aftermarket parts, custom parts, decorative parts, cosmetic parts, electronic components, accessories, and related products manufactured, sold, distributed, marketed, offered, or otherwise provided by Habibi Carbon LLC, including its members, managers, officers, employees, contractors, agents, representatives, affiliates, successors, assigns, suppliers, distributors, and related parties (collectively "Habibi Carbon," "Company," "Seller," "we," "us," or "our").
By clicking any acknowledgment box, proceeding to checkout, completing a purchase, accepting delivery, installing, using, or possessing any Habibi Carbon product, the purchaser ("Purchaser," "Customer," "you," or "your") acknowledges, understands, and agrees to the following notice, waiver, disclosure, assumption of risk, disclaimer, indemnification, and limitation of liability.
Section One
Covered Products
This Website Waiver applies to all products sold, distributed, marketed, offered, or otherwise provided by Habibi Carbon, including but not limited to:
- Aftermarket steering wheels
- Air-bag covers
- Lights & side markers
- Key fobs
- Aftermarket replacement parts
- Custom automotive parts
- Cosmetic automotive parts
- Decorative automotive components
- Electronic accessories
- Vehicle accessories
- Any related product or item sold by Habibi Carbon
All such products are collectively referred to herein as the "Products."
Section Two
Off-Road, Racing, and Non-Public-Road Use Only
You are hereby placed on express notice that all Products are sold strictly and exclusively for off-road use, racing use, closed-course use, track use, motorsport use, show use, display use, or other uses that do not involve operation of a vehicle on public streets, roads, or highways.
For purposes of this Website Waiver, "off-road use," "racing use," and "non-public-road use" mean use in private, controlled, non-public-road environments, including closed-course racing, motorsport events, competition vehicles, track-only vehicles, off-road vehicles, show vehicles, display vehicles, and private-property vehicles.
These terms do not include street driving, daily driving, highway driving, commuting, ordinary transportation, or public-road operation. Any installation or use of any Product on a vehicle operated on public roads is undertaken solely at the Purchaser's own risk.
Section Three
No Representation of Legality, Safety, or Compliance
Habibi Carbon makes no representation, warranty, certification, guarantee, or assurance that any Product is legal, safe, street legal, road legal, compliant, insurable, inspectable, roadworthy, compatible, warranty-preserving, or appropriate for public-road use, vehicle inspection, vehicle registration, insurance purposes, emissions purposes, safety compliance, lighting compliance, crashworthiness compliance, or operation on any public road.
Unless expressly stated in a separate written document signed by an authorized representative of Habibi Carbon, no Product is represented as FMVSS-compliant, NHTSA-certified, DOT-approved, SAE-approved, OEM-approved, crash-certified, inspection-certified, airbag-certified, lighting-certified, or approved by any governmental agency, regulatory body, vehicle manufacturer, insurance carrier, or safety organization.
Section Four
Product-Specific Notices
A. Steering Wheels
Aftermarket steering wheels may remove, disable, interfere with, bypass, compromise, impair, or alter factory-installed equipment and safety systems, including airbags, supplemental restraint systems, crash sensors, horn systems, steering-wheel controls, electronic controls, warning lights, steering-column components, collapsible steering-column features, and driver-assistance systems. Improper installation or use may increase the risk of serious bodily injury, death, vehicle damage, property damage, failed inspection, insurance denial, warranty denial, civil liability, criminal liability, or regulatory enforcement.
B. Air-Bag Covers
Air-bag covers are aftermarket, custom, cosmetic, decorative, or replacement components and may affect, interfere with, alter, impair, obstruct, delay, or prevent the operation, deployment, timing, performance, or effectiveness of an airbag, supplemental restraint system, crash sensor system, or other factory-installed safety equipment. Improper installation or use may increase the risk of serious bodily injury, death, vehicle damage, failed inspection, insurance denial, or regulatory enforcement.
C. Lights & Side Markers
Lights and side markers are aftermarket, custom, cosmetic, decorative, electronic, or replacement components and may not satisfy applicable brightness, color, visibility, reflectivity, signaling, placement, wiring, equipment, inspection, public-road safety, or lighting requirements. Improper or noncompliant lighting may increase the risk of accident, reduced visibility, citation, failed inspection, insurance denial, property damage, personal injury, or death.
D. Key Fobs
Key fobs are aftermarket, custom, decorative, electronic, cosmetic, or replacement components and may not be compatible with all vehicle systems, security systems, immobilizer systems, remote-entry systems, alarm systems, ignition systems, or electronic control modules. Habibi Carbon makes no representation that any key fob is legal, safe, compatible, programmable, functional, secure, theft-resistant, manufacturer-approved, dealership-approved, or warranty-preserving. Purchase or use of a key fob may result in malfunction, incompatibility, loss of vehicle access, vehicle disablement, warranty denial, or other damages.
Section Five
General Vehicle-System Notice
Without limiting the product-specific notices above, installation, programming, wiring, modification, or use of any Product may affect, remove, disable, interfere with, bypass, compromise, impair, or alter factory-installed safety, electrical, lighting, restraint, airbag, warning, security, key, immobilizer, alarm, remote-entry, driver-assistance, vehicle-control, or other original manufacturer systems.
Purchaser assumes all risks arising from any such interference, alteration, malfunction, incompatibility, impairment, disablement, or unintended vehicle-system effect, including serious bodily injury, death, vehicle damage, property damage, failed inspection, loss of insurance coverage, denial of insurance claims, loss of manufacturer warranty, civil penalties, criminal penalties, regulatory enforcement, vehicle disablement, and third-party claims.
Section Six
Purchaser's Sole Responsibility
Purchaser is solely and exclusively responsible for determining whether the purchase, installation, programming, wiring, use, modification, inspection, insurance, registration, operation, resale, transfer, and possession of any Product is lawful, safe, compatible, insurable, inspectable, roadworthy, and appropriate for Purchaser's vehicle, jurisdiction, event, track, racing series, intended environment, and intended use.
Purchaser is solely responsible for consulting qualified professionals before purchase, installation, programming, wiring, modification, use, resale, transfer, or operation, including but not limited to a licensed mechanic, professional installer, automotive electrician, automotive engineer, vehicle manufacturer, dealership, locksmith, inspection authority, insurance carrier, event organizer, track official, racing organization, and legal counsel.
Habibi Carbon does not provide legal, regulatory, engineering, safety certification, vehicle inspection, insurance, installation, programming, electrical, mechanical, racing-rule, or compliance advice.
Section Seven
No Reliance on Product Images, Listings, or Marketing Materials
Product images, photographs, renderings, listings, descriptions, marketing materials, social media posts, advertisements, and communications are for illustrative, promotional, and decorative purposes only and do not constitute representations of legality, safety, compliance, compatibility, roadworthiness, performance, or suitability for any particular use or vehicle. Purchaser agrees not to rely on any such materials in making any purchase, installation, or use decision.
